TPCAR event policies
Please carefully read the following policies as they pertain to attendance at a TPCAR event or educational class/conference. By registering for a TPCAR event or educational class/conference, you agree to accept the following terms and conditions.
MEDIA RELEASE
Tacoma-Pierce County Association of REALTORS® may be photographing and/or filming during this event. By agreeing and submitting your registration for this event, you grant permission to Tacoma-Pierce County Association of REALTORS® to use your image (photograph and/or video) for use in media publications, including but not limited to videos, email blasts, brochures, newsletters, magazines, general publications, and website. You hereby waive any right to inspect or approve finished photographs or electronic matter that may be used in conjunction with them now or in the future, whether that use is known to you or unknown. You hereby waive any right to royalties or other compensation arising from or related to the use of the image.
EVENT WAIVER & RELEASE
TACOMA-PIERCE COUNTY ASSOCIATION OF REALTORS® - Waiver & Release of Claims
You desire to attend and willingly participate in the Tacoma-Pierce County Association of REALTORS® event (“TPCAR Event”) hosted by the Tacoma-Pierce County Association of REALTORS®, a Washington not-for-profit organization (“TPCAR”) at 2550 S Yakima Ave, Suite C, Tacoma, WA 98367. In consideration of being permitted to attend and participate in the TPCAR Event, and in recognition of TPCAR’s reliance hereon, you agree to the terms and conditions set forth in this agreement (“Release”).
You are aware of the contagious nature of communicable diseases (collectively, “Disease”), and of the risk that you may be exposed to or contract Disease through your attendance at the TPCAR Event. You understand that while TPCAR has implemented measures to reduce the risks associated with the TPCAR Event and the spread of Disease, you understand that TPCAR cannot guarantee that you will not be exposed or become infected with Disease by attending the TPCAR Event.
ASSUMPTION OF RISK
NOTWITHSTANDING THE AFOREMENTIONED RISKS, YOU ACKNOWLEDGE THAT YOU ARE VOLUNTARILY PARTICIPATING IN THE TPCAR EVENT WITH KNOWLEDGE OF THE DANGERS INVOLVED AND THAT YOUR ATTENDANCE INCLUDES THE POSSIBILITY OF EXPOSURE TO AND ILLNESS FROM DISEASE. YOU HEREBY KNOWINGLY AND FREELY AGREE TO ACCEPT AND ASSUME ALL RISKS OF INJURY, ILLNESS, DISABILITY, DEATH, HARM, AND ECONOMIC LOSS ASSOCIATED WITH OR ARISING FROM YOUR ATTENDANCE AT THE TPCAR EVENT, WHETHER CAUSED BY THE NEGLIGENCE OR CONDUCT OF TPCAR OR ANY RELEASE HEREUNDER.
RELEASE AND WAIVER
YOU HEREBY EXPRESSLY WAIVE AND RELEASE ANY AND ALL CLAIMS AND DEMANDS OF WHATEVER KIND OR NATURE NOW KNOWN OR HEREAFTER KNOWN, AGAINST TPCAR, AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES (COLLECTIVELY, “RELEASEES”), EITHER IN LAW OR EQUITY, AND THAT THIS RELEASE IS INTENDED TO BE AS BROAD AND INCLUSIVE TO THE FULLEST EXTENT PERMISSIBLE BY LAW, INCLUDING BUT NOT LIMITED TO DAMAGES OR LOSSES CAUSED BY THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND ON THE PART OF THE RELEASEES, INCLUDING BUT NOT LIMITED TO ILLNESS, DISABILITY, DEATH, ECONOMIC LOSS OR OUT OF POCKET EXPENSES OR LOSS OR DAMAGE TO PROPERTY ARISING OUT OF OR ATTRIBUTABLE TO YOUR PARTICIPATION IN AND ATTENDANCE AT THE TPCAR EVENT, WHETHER CAUSED BY OR ARISING OUT OF THE NEGLIGENCE, FAULT OR CONDUCT OF ANY KIND OF NAR OR ANY RELEASEES. YOU COVENANT NOT TO MAKE OR BRING ANY CLAIM YOU, YOUR HEIRS, ASSIGNEES, NEXT OF KIN AND/OR LEGALLY APPOINTED OR DESIGNATED REPRESENTATIVE, MAY HAVE OR WHICH MAY HEREINAFTER ACCRUE ON YOUR BEHALF AGAINST NAR OR ANY RELEASEE, AND FOREVER RELEASE AND DISCHARGE TPCAR AND ALL RELEASEES FROM LIABILITY FOR SUCH CLAIMS.
MEDICAL ACKNOWLEDGEMENT AND RELEASE
You confirm and agree that: a) you will not attend the TPCAR Event if you are experiencing any symptoms of Disease, have confirmed or suspected case of Disease, or if you are required to quarantine in accordance with CDC or locally applicable guidelines; b) you will comply with all applicable federal, state, and local laws, orders, guidelines and directives; c) you will comply with all safety protocols imposed by TPCAR at all times during the TPCAR Event; d) you will immediately cease participation in the TPCAR Event if you become ill or begin experiencing any symptoms of Disease.
YOU HEREBY CONSENT TO RECEIVE ANY MEDICAL TREATMENT DEEMED NECESSARY IF YOU ARE INJURED OR REQUIRE MEDICAL ATTENTION DURING YOUR PARTICIPATION IN THE TPCAR EVENT. YOU UNDERSTAND AND AGREE THAT YOU ARE SOLELY RESPONSIBLE FOR ALL COSTS RELATED TO SUCH MEDICAL TREATMENT AND ANY RELEATED MEDICAL TRANSPORTATION AND/OR EVACUATION. YOU HEREBY RELEASE, FOREVER DISCHARGE, AND HOLD HARMLESS TPCAR AND THE RELEASEES FROM ANY CLAIM BASED ON SUCH TREATMENT OR OTHER MEDICAL SERVICES RENDERED IN CONNECTION WITH YOUR PARTICIPATION IN THE TPCAR EVENT.
INDEMNIFICATION
You agree to indemnify and hold harmless TPCAR and all other Releasees against any all claims, actions, suits, procedures, costs, expenses, damages, liabilities, and expenses of whatever kind, including attorney fees, brought as a result of my participation in the TPCAR Event and Disease.
This Release constitutes the sole and entire agreement of TPCAR and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both TPCAR written and oral, with respect to such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability will not affect any other term or provision of this Release or invalidate or render unenforceable such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of TPCAR and the Releasees and me. All matters arising out of or relating to this Release will be governed by and construed in accordance with the laws of the State of Washington without giving effect to any choice or conflict of law provision or rule. Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Thurston County, Washington and you hereby consent to the exclusive jurisdiction of such courts.
BY ATTENDING AND/OR PARTICIPATING IN THE TPCAR EVENT, YOU ARE DEEMED TO HAVE GIVEN A FULL RELEASE OF LIABILITY TO THE RELEASEES TO THE FULLEST EXTENT PERMITTED BY LAW, BY SIGNING, YOU ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD ALL OF THE TERMS OF THIS RELEASE AND THAT YOU ARE VOLUNTARILY GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE TPCAR AND THE RELEASEES.
Meeting/Class Code of Conduct
TPCAR strives to provide an event experience that is positive and rewarding for everyone. By attending a TPCAR event/class, you agree to abide by this Statement of Appropriate Event/Class Conduct and Meeting Policies.
Statement of Appropriate Event Conduct
All attendees (including TPCAR members, guests, exhibitors, staff and vendors) are expected to conduct themselves professionally and with good judgment and common sense. That means at all times being respectful of others and of the venues in which events are held, including virtual meetings platforms, broadcast platforms chats, and virtual networking chat rooms associated with TPCAR events.
TPCAR aims to provide a safe event experience for all attendees and does not tolerate inappropriate behavior or harassment in any form. Inappropriate behavior includes harassing or defamatory verbal or TPCAR written comments, displays of illicit images or use of illicit language, threats, intimidation, discrimination and unwanted physical contact.
TPCAR reserves the right to remove any guest who is disruptive. As an attendee at an association sponsored event, you are responsible for your behavior and that of your guests. Our expectation is that you will appropriately represent TPCAR and support its brand and reputation through your professional behavior. If you choose to consume alcohol, you are expected to drink responsibly, use good judgement, obey the law, including laws prohibiting drinking and driving and comply with venue policies.
Attendees who violate this Statement of Appropriate Event Conduct may be removed from the meetings. In addition, attendees found in violation of this Statement may not be permitted to participate in future TPCAR events at the discretion of association leadership.
We value your attendance and thank you for your cooperation to ensure a safe experience for all.
TPCAR PARKING
TPCAR does not guarantee the safety or protection of personal property on the TPCAR premises or at off-location TPCAR events and is not responsible for loss and/or theft of personal belongings. TPCAR encourages attendees to take all precautions to protect their own safety and protection of personal property.
Meeting/Class Policies
Presentation materials are copyrighted by the speakers, their companies or others from whom they have received permission to use. TPCAR written permission from the Association/speaker is required before recording or re-publishing.
Cancellations
Refunds or credits will be made for canceled registrations, provided the cancellation request is received by the event registrar at least 3 business days prior to the start of the event.
A flat rate cancellation fee of $10.00 will be applied to cancellation requests of registrants that paid by credit card.
Substitutions are welcome and encouraged for any event.
Refunds and credits will not be permitted for registration cancellations made the day of the event, or for no-shows.
Sold Out Events
Seats at sold out events will be held only until the scheduled start time for the program. Pre-registration will not guarantee seating for late arrivals. Waitlists for events will also be available.
Severe Weather Policy
Driving conditions may vary greatly for event participants depending on where they live and work. If it is reasonably possible, TPCAR events will take place as scheduled. TPCAR is not liable for cancellations or changes due to circumstances beyond its control (natural disasters, strikes, etc.).
For morning events (programs that start before 11:00A): The Tacoma-Pierce County Association of REALTORS® will contact registrants via email by 7:00A. Event cancellation or change of notices will be posted on the event's calendar and social media by 7:00A.
For events starting later in the day (programs that start after 11:00A): The Tacoma-Pierce County Association of REALTORS® will contact registrants via email 2 hours prior to the event. Event cancellation or change notices will be posted on the event's calendar and social media 2 hours prior to the event.
Accessibility & Accommodation Statement
TPCAR will make reasonable accommodations to support participation in our events. Requests for accommodation must be submitted at least one week prior to the event date and will be honored to the fullest extent possible.
